  1. Go back and read the DeCSS decisions which stated flat out that knowingly linking to material in violation of the DMCA for the purpose of disseminating it was itself a violation of the DMCA. It’s a little bit different here because it’s a copyright violation and not an anticircumvention violation, but the logic will probably stand. You’ll have to get Congress or the Supreme Court to change its mind if you’re looking for a different outcome.

  3. Search engines are served with DMCA notices to remove search results which link to copyrighted material every day.

    I wouldn’t assume anything as far as legality these days – the ongoing assault and disregard of the constitution / bill of rights moves on with more and more police state legislation being passed which favors those who pay off the influence peddlers. We’re even going to lose our right to free speech – Newt is all over the press calling for it and the “hate laws” about to be passed will end any voice which dissents.

  6. it’s one of those things you have to weigh out, for sure. I think even if there’s a case (which I don’t think there is) the fact is the person is linking to copyrighted material, and since someone else owns the material and it’s being pirated, ethically it’s wrong, at least. I don’t think we’re in a deeplinking/link policy debate here, since that was all sort of settled in the late 90’s, so for me, no big deal.

  7. It is not fair FOX is taken such unfair action upon Quicksilverscreen. If FOX is going to do this, they should sued the first person who allow the show to appear on the internet. The resource where he got it from is even there all along. I feel bad for Steve, the owner of Quicksilverscreen, as I believe he must have put a lot of work and risk on this work. Watching such tv shows on Quicksilverscreen is just like watching it on tv. It isn’t selling or making any profit off of it, so why should it shut down? This is just isn’t fair.

  8. That is just redicioulous, it’s horrible PR for fox. I hate to see what they would to do sites http://www.freetube.us.tc that actually broadcast the Fox station itself. But seriously, they should let these sites remain as they are – it helps promote their shows and I wouldn’t have known about some of their shows (like the really obscure ones) if I hadn’t first seen them on the internet. I have Fox/NBC etc but I only really started watch some of the programs after watching it online for the first time, and then now I watch a lot of their shows.

    So it actually helps them. They’re such greedy bastards.

  15. Truth is, you stop one and 10 others pop up. Stopping QSS means nothing but a poor guy losing 8 years of work, but in essence, those 8 years changed how shows/videos have gotten to the masses.

    My question for the large tv/sales/marketing conglomerates is have they justly weighed the outcome of their actions? That the site can just as easily exist in another country (as it does so you can go “frack” urself FOX…haha jokes on you), is it worth the harassment and bad PR to prey upon the little guy?! I don’t think so…

    I have a comment to Google (via YouTube) too though. I certainly hope you don’t fall susceptible to these allegations; fight them to the end. How I would respect Google and NEVER use another search engine if they make FOX et al. look like jackasses for this!!!

    If you check the copyright by-laws. There is no way for someone to actually copy these files. They are a link that you need to be connected to the net in order to get. Thus, it is not really considered file sharing. I believe FOX is making a huge mistake. As a person already wrote, they got to know / see some of the shows on here they have not watched before. I know I can not afford to buy or rent full seasons of shows like 24 and Family Guy. I just got into 24 last season and with 4 season to watch previously I thought this is great. If you rent the money does not go to fox it goes to the video store chain. I thought this was a great idea. I still do. I say fight the fight.

    the main thing that is wrong with this is that fox is public broadcasting aka free tv. unless fox loses profit/funding because of this site wich i use quite often they have no legal reason for this lawsuit. and if they get away with it who’s next to sue this “steve”? whyy for red dwarf? unless its payperveiw they have no right for this legal act.

    That’s not true Blah. Fox pays for and owns the content. If they choose to make money from it by offering it free with adverts or by paid subscription that is their choice.

    If someone steals it by hosting it on their site (e.g YouTube) then Fox has the right to make them take it down. YouTube also has the right (under current DMCA laws) to be asked to take it down first before being sued because they can’t be expected to know what every member of their community is up to.

    The question here is does Fox have the right to tell QuickSilverScreen to remove the links to he pirate videos on YouTube. Is it not YouTube’s responsibility? Or is is QuickSilverScreen contributing to the copyright infringment?

    This would all be solved if Fox simply put more TV shows online which were free and supported by minimal adverts, which were well targeted to the audience.

    Simply put the owner of this site got screwed. Albeit not as badly as the owner of tv-links.co.uk who was actually jailed in the UK. Providing a link is just that, showing someone where to go. If someone stops you on the street and asks where the bank is and you tell them and then they rob the bank are you responsible for their actions? Not to mention that FOX shoots themselves in the foot with this. Word of mouth is so much more now than it used to be… the net spreads things like wild fire and honestly FOX, we dont need you. Think about Metallica and how many faithful fans they lost after the napster debacle… I dont debate that artists have a right to their property but I do think that you need to go after those who are actually guilty of something, not those who give out road maps….

    As you may or may not know Qss was recently accused of copyright violations AGAIN. im happy to report however that it is of no consequence, the site will continue to prosper regardless of the findings of the malaysian justice system. Should the site be forced to shut down it will simpely be reopened in another country, while FOX and others spend another 3-4 years building a case according to said country’s justice system. GLHF.

  65. Ask yourselves this question? How many movie downloading sites are there? Are the BIG BOYS of Hollywood going to be out numbered by the questionable movie downloading sites?

    I think most of us can guess at the answers for the two questions above… The amount of movie downloading sites clearly may reach way beyond the scope of the MPAA. Unless the MPAA hires John Connor from the Terminator to use some Skynet tactics! Possible? Ummmm….

    We can go to sites that have legal content like Cinemanow, MovieDownloadMatrix, Movielink and Netflix….

    But most people can not afford to do that…therefore alternatives always catch the masses…on the other hand I can understand the importance of sharing…Even before the internet…did any of use take a video we bought over to a friends house to watch… sure we did! Live on QSS!!!

  67. Until the owners of movie theatres quite raising the price of movie tickets, I hope sites like this stay in circulation. It is unfair that for even a small sized faily to see a movie it is a small fortune. Why is this anyway? To pay actors salaries?? Seriously? I am really curious as to the answer…..

  68. The copyright laws in the states are insane, I don’t see why they would be liable since its only a link. Why don’t they go after the people hosting the content.
